可口可乐与汇源集中案之解析
[摘 要] 商务部做出了否决可口可乐与汇源集中申请的裁决,但是,商务部并没有公布其理由及过程。这一举动引起了诸多质疑,严重影响了商务部裁决的合理性。运用反垄断法知识对商务部的裁决进行解释,探明其真实意图具有重大实际意义!同时,以该案作为具体分析对象,阐明我国反垄断法的知识形态应以法律解释为主导路径的实际价值,并通过法律解释与适用的过程来促进反垄断法知识的增长。

The Analysis of Coca-Cola/Huiyuan Concentration

Abstract:The Ministry of Commerce of the People’s Republic of China has made the decision to block the Coca Cola/Huiyuan concentration. However, the Ministry of Commerce of the People’s Republic of China has not published the reasons and process of the decision. So, it has caused a lot of questions, and seriously affected the rationality of the decision. Therefore, there is a great practical significance for applying the knowledge of the anti monopoly law to explain the decision, and proving the true intention of the ministry of commerce of the people’s republic of China on Coca Cola/Huiyuan concentration. Moreover, the concrete analysis of this case also illustratesChina’s anti monopoly law should adopt the approach of the legal interpretation. At the same time, their knowledge would be increased in the process of interpreting and applyingChina’s anti monopoly law.
