中国家长体罚未成年子女因素及消除体罚路径分析
摘 要：随着全球儿童权益保护意识的日益提高，虐待儿童引起了更多的关注。中国和澳大利亚在二十世纪九十年代就签署及实行了《联合国儿童权利公约》，虽然'合理“体罚儿童现象在澳大利亚依然存在，但是中国家长体罚儿童的普遍性远远高于澳大利亚。从个人、家庭、社区、文化及政策角度探讨中国家长体罚未成年子女普遍率居高的原因，并借鉴澳大利亚消除家长体罚未成年子女的经验，提出消除中国家长体罚未成年子女的几种可能途径。

Abstract： With the increasingly global recognition of the interests of children， child abuse has attracted considerable attention. In 1990s， the United Nations Convention on the Rights of the Child （UNCRC） came into force in both China and Australia. However， 'reasonable“ corporal punishment still exists in Australia， and the much higher prevalence of physical punishment can be seen in China than that in Australia. This article will discuss factors that lead to the high prevalence of corporal punishment in China at individual， family， community， cultural and policy level respectively. The possible ways to eliminate physical punishment of children in China will also be given.

未成年子女常常被視为是父母的私人财产。尽管定义是社会构建出来的，并且形式和流行程度可能在不同文化和地区之间存在显著差异，但针对儿童的暴力行为却没有文化边界、社会边界甚至宗教边界。自1989年以来，儿童的权利就已在《联合国儿童权利公约》（UNCRC）中得到承认。除美国和索马里外，世界上每个国家都已签署《联合国儿童权利公约》。澳大利亚和中国分别在1991年和1992年开始实行《联合国儿童权利公约》。随着全球对儿童利益的认识日益提高，在过去的几十年中，特别是在西方，虐待儿童引起了相当多...
